Supplementary protection in Poland — residence card and further legalization

7 minD&V Legal Group

Supplementary protection is different from refugee status. Check which documents to prepare for review and when further residence planning needs a consultation.

This page explains how to treat subsidiary protection when planning further legalization and preparing documents for a D&V consultation.

Subsidiary protection differs from refugee status. We do not recommend a path without the decision, documents and risk assessment.

What this situation means

Subsidiary protection is a form of international protection granted in circumstances different from refugee status. In practice, the residence card, travel documents and further residence bases require a separate review.

When this path may matter

It may matter when checking or replacing documents, planning permanent residence, EU long-term residence, work, family matters, travel or issues connected with a missing passport.

What not to confuse

Subsidiary protection is not refugee status, UKR status or an ordinary work or study basis. Do not assume that documents and rights are identical to refugee status.

Documents to prepare for a consultation

Prepare the decision, residence card, passport or travel document, stay history, official letters, income, family, study and work documents, and information about trips outside Poland.

Common risks

Typical risks include no passport, unclear travel-document status, changed data, long trips, missing income documents or choosing an ordinary path without checking the protection status.

When a consultation is needed

A consultation is needed when documents expire, there is a summons or refusal, the passport is missing, data is inconsistent or a change of residence basis is planned.

How D&V qualifies the case

D&V starts with qualification of status, documents, risk, the competent authority and the possible path. The public work standard is described on the Work Standard page; the internal operating workflow is not published.

Recommended next step

Start with a document review after protection or a consultation. Only after qualification should a pricing package be selected.

Legal information

This information does not replace an individual document review. The final path depends on decisions, dates of stay, documents, current rules and the competent authority.

Frequently asked questions

Does subsidiary protection follow the same path as refugee status?
Not always. The decision and documents need separate analysis.
Does a missing passport block every case?
This cannot be assessed automatically. The status and travel-document option must be checked.

Preliminary qualification is not an administrative decision. The client logs in to the state system, signs and submits the application themselves where the procedure requires it.
